§ 1. General Provisions

This Privacy Policy sets out the rules for the processing and protection of personal data of persons using the website available at www.belogistics.pl (hereinafter the “Website”), as well as the rules for the use of cookies.

The Controller attaches particular importance to protecting the privacy of Website users. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “GDPR”), and the Act of 10 May 2018 on the Protection of Personal Data.

§ 3. Scope, Purposes and Legal Bases of Data Processing

The Controller processes personal data to the extent necessary to achieve the individual purposes and on the basis of the relevant provisions of the GDPR.

1. Contact by e-mail and telephone

Where the Controller is contacted by e-mail or telephone, the Controller processes the data provided by the person making contact, including the e-mail address, telephone number and other data contained in the message.

• Purpose: handling the enquiry and conducting correspondence.
• Legal basis: Article 6(1)(f) of the GDPR – the Controller’s legitimate interest in handling enquiries addressed to it, and to the extent that the contact is aimed at concluding a contract – Article 6(1)(b) of the GDPR.

2. Statistics and analytics (Google Analytics)

The Controller uses Google Analytics to compile statistics and analyse the way the Website is used. In this respect, data relating to activity on the Website may be processed, including device information, the IP address (in anonymised form) and cookie identifiers.

• Purpose: compiling statistics and analysing traffic on the Website in order to improve it.
• Legal basis: Article 6(1)(a) of the GDPR – consent given via browser settings or the cookie banner.

3. Establishing, pursuing or defending claims

Legal basis: Article 6(1)(f) of the GDPR – the Controller’s legitimate interest in being able to establish, pursue or defend against claims.

§ 4. Voluntary Provision of Data

The provision of personal data is voluntary, but necessary to use certain functionalities of the Website, in particular to contact the Controller and receive a reply to an enquiry. Failure to provide data may make it impossible to handle the request.

§ 5. Data Recipients

Personal data may be transferred to entities supporting the Controller in running its business and the Website, in particular:

• providers of hosting and Website maintenance services;
• providers of IT, e-mail and software services;
• providers of analytics tools (Google Ireland Limited / Google LLC – with respect to Google Analytics);
• entities providing legal, accounting or advisory services;
• authorised state authorities, where the obligation to transfer data arises from provisions of law.

These entities process the data on the basis of data processing agreements concluded with the Controller and solely in accordance with its instructions.

§ 6. Transfer of Data Outside the European Economic Area

In connection with the use of Google Analytics, data may be transferred to countries outside the European Economic Area (EEA), including the United States. Data are transferred on the basis of appropriate safeguards provided for in the GDPR, in particular standard contractual clauses approved by the European Commission or other permissible mechanisms ensuring an adequate level of data protection.

§ 7. Data Retention Period

Personal data are stored for the period necessary to achieve the purposes for which they were collected, in particular:

• data processed in connection with correspondence – for the time necessary to handle the enquiry, and subsequently for the limitation period of any claims;
• data processed on the basis of consent (e.g. in analytics tools) – until the consent is withdrawn or the cookies expire;
• data processed for the purpose of establishing, pursuing or defending claims – for the limitation period of claims arising from provisions of law.

§ 8. Rights of Data Subjects

In connection with the processing of personal data, every person has:

• the right to access their data and receive a copy of them;
• the right to rectification (correction) of data;
• the right to erasure of data (the “right to be forgotten”);
• the right to restriction of data processing;
• the right to data portability;
• the right to object to the processing of data based on the Controller’s legitimate interest;
• the right to withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal – where processing is based on consent;
• the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warszawa).

In order to exercise the above rights, please contact the Controller in the manner indicated in § 2 of this Policy.

§ 9. Cookies

The Website uses cookies – small text files saved on the user’s end device while using the Website.

The following types of cookies are used within the Website:

• essential (technical) cookies – necessary for the proper functioning of the Website; they do not require the user’s consent;
• analytics/statistical cookies – used to compile statistics and analyse the way the Website is used (Google Analytics); they are installed only with the user’s consent.

The user may at any time change the settings concerning cookies, specifying the conditions of their storage and access via the web browser settings, including blocking them entirely. Restricting the use of cookies may affect certain functionalities of the Website.

§ 10. Data Security

The Controller applies appropriate technical and organisational measures to ensure the protection of the personal data processed, adequate to the risks and the categories of data protected, and in particular protects the data against disclosure to unauthorised persons, loss, damage or destruction.

§ 11. Final Provisions

The Controller reserves the right to make changes to this Privacy Policy, in particular in the event of changes in the law, the technologies used on the Website or the scope of services provided. The current version of the Privacy Policy is available on the Website at all times.

In matters not regulated by this Privacy Policy, the relevant provisions of Polish law shall apply, in particular the GDPR and the Act on the Protection of Personal Data.
